Time is running out! 2023 is just weeks away, and all licensees need to renew their license for the upcom-
ing year prior to expiration on December 31st. Failure to renew a license can result in denial of permits
and disciplinary action by the Board if work is done on an expired license.
Individuals who hold a currently active license for 2022 are able to renew online for 2023. Renewal notic-
es which contained the username and password in early October. There are three ways to renew.
The preferred method is through the online portal using a MasterCard or Visa. You will need a valid email
address to renew online. If you use this method, you should print your license following payment, as a
printed copy will not be mailed from the Board’s office if the license is renewed online.
The second option is to email or fax the signed renewal form to the Board office, and a link will be sent
for online payment. The third option is to mail the signed renewal form to the Board’s office with a check
or money order. Please note that the renewal will not be processed until payment is received, regardless
of the method used.
Licensees who expired in 2019, 2020, or 2021 may renew by submitting a completed paper renewal form
and payment (check or money order) to the Board office. You may also email the signed renewal form to
[email protected] and request a link to pay your fees online. Keep in mind that all forms are pro-
cessed in the order received and must still be completed PRIOR to 12/31/2022 in order for the license to
be renewed successfully. This is not an automated process.
Please note that if the license expired in 2019, it may be renewed until December 31, 2022. After that, the
license will be retired, and the individual will be required to take and pass all applicable examinations in
order to reinstate the license.
Have You Renewed Your License Yet?
The North Carolina State Board of Examiners of Plumbing, Heating and Fire Sprinkler Contractors and
the South Carolina Contractor’s Residential and Commercial Licensing Boards have entered into partial
examination waiver agreements for licensees who hold licenses obtained by examination in either state.
The agreements exempt a currently licensed contractor from the technical portion of the contractor
examinations when applying for licensure in their neighboring state. The applicant is still required to take
and pass the business law examination of the state that is being applied for.
When applying for a license, the applicant must request a license verification from the Board that issued
their license, which that Board will email to the Board that they are applying to. Additional information is

Resolution Agreements
A Field Resolution Agreement is a voluntary agreement by which a licensee enters into some type of sanctions against their license instead
of appearing before the Resolution Review Committee or the Full Board at a formal hearing. All of the Agreements are reviewed by a mem-
ber of the Resolution Review Committee and then presented to a Board hearing panel for approval prior to the agreement being adopted
as a final agency decision. If a complaint has not been resolved in the field through a Field Resolution Agreement, then the case can be re-
ferred to the Resolution Review Committee. During the Resolution Review Committee meeting, a licensee can enter into a Review Com-
mittee Resolution Agreement in place of appearing before the Board at a formal hearing; the agreement is then presented to a Board hear-
ing panel for approval prior to the agreement being adopted as a final agency decision. Cases that cannot be resolved through the use of
Field Resolution Agreements or Review Committee Resolution Agreements are forwarded to formal hearings before the Board. Listed
below are the different agreements entered into by the field staff and the Resolution Review Committee that have been approved by the
Board. The information below does not contain all of the facts or details of each case. Specific details of any of the following cases can be

violation of GS 87-21 and the Board laws and
Rules section .0512.
Danny Barkley signed a Proposed Resolution
Agreement 06/16/2022.
The Review Committee found that the alle-
gations were supported by the evidence and
recommended that the license of Danny
Barkley, number 24377, P-I, and that of the
firm shall be placed on a unsupervised proba-
tion for a period of twelve (12) months.
Among other requirements during the pro-
bation, the licensee shall enroll in, attend,
and complete the Special Board Laws &

of all employee W-4’s and by the end of the

Allegations the licensee knowingly contract-
ed a Heating Group 2 job, with a total of 20
tons cooling, while only holding a Heating
Group 3, Class II License. The installation as
started around September of 2021. Licensee
failed to obtain a permit prior to commenc-
ing work.
Resolution Conference held 06/29/2022.
The Review Committee found that the alle-
gations were supported by the evidence and
recommended that the license of Ervin Britt,
number 32563 H-3-II, and the license of the
firm be suspended for a period of eighteen
(18) months. Among other requirements
during the suspension, the licensee shall en-
roll in, attend and complete the Special
Board Laws & Rules course. Upon successful
completion of the suspension, his license,
number 32563 H-3-II, and that of the firm
shall be placed on supervised probation for a
period of twenty-four (24) months.

Allegations the licensee failed to provide
supervision, failed to carry out adequate
ductwork installation and system design,
failed to install a by-pass on a single stage
equipment serving two floors, violated the
minimum standard of the North Carolina
State Mechanical Code, violated the mini-
mum standard of the North Carolina State
Fuel Gas Code, installation performed in a
poor workman like manner / poor workman-
ship, and the firm failed to provide docu-
ments to the board upon request.
Resolution Conference held 06/27/2022.
The Review Committee found that the alle-
gations were supported by the evidence and
recommended that the license of Andrew C.
Burgess, number 33004 H-3-I, and that of the
firm shall be placed on supervised probation
for a period of twenty-four (24 months).
Among other requirements during the pro-
bation, within thirty (30) days of institution
of this agreement the firm shall have a sec-
ond licensee who will qualify the firm with an
H-3 license, the licensee shall enroll in, at-
tend, and complete the series of Special Me-
chanical Code courses, the licensee shall
enroll in, attend, and complete the series of
Special Fuel Gas Code and Design courses
and the Special Board Laws & Rules course.

gations were supported by the evidence and
recommended that the license of Paul Cam-
den, number 18903 P-I, and that of the firm
shall be placed on a unsupervised probation
for a period of twelve (12) months. Among
other requirements during the probation,
licensee shall enroll in, attend, and complete
the Special Board Laws & Rules course and
submit to the Board’s office within the next
thirty (30) days copies of all employee W-4’s
and by the end of the probation submit a
copy of all employee W-2’s.
Cape Fear Mechanical

Allegations that owner/operator allowed the
licensee of the firm to license the firm, Cape
Fear Mechanical & General Contracting, Inc.
while the license was actively employed with
another license firm out of Raleigh, NC while
the firm was performing work that requires a
license, failed to assure that the licensee of
the firm meets the minimum employment
required as the licensee of the firm, the firm
allowed permits to be pulled for jobs con-
tracted and installed by an unlicensed person
(Alan Stewart). This happened multiple
times, after the licensee removed his license
from the firm (March 17, 2021), the firm
continued working performing work that
requires a license as an unlicensed firm.
Resolution Conferences held 12/09/2021.
The Review Committee found that the alle-
gations were supported by the evidence and
recommended that the license of the firm,
Cape Fear Mechanical and General Contract-
ing, Inc., and Cape Fear Climate Control Inc,
be suspended for a period of two (2) years.
Among other requirements during the sus-
pension, James Mark Hammond, owner/
operator of the firm, shall enroll in, attend,
and complete the Special Board Laws &
Rules course.

Allegations the licensee failed to perform a
load calculation for the HVAC installation on
this complaint, pulled a permit for a firm that
was not licensed, allowed the use of license
by unlicensed persons, and obtained a permit
and allowed his license number to appear on
a permit on a job where the licensee did not
hold the contract with the homeowner or
general contractor, the licensee did not su-
pervise, the installation was not performed
by the licensee or bona-fide employees of the
licensee and did not receive the contractual
payment for the job.
Resolution Conference held 06/28/2022.
The Review Committee found that the alle-
gations were supported by the evidence and
recommended that the license of Michael
Farr, number 23177 H-3-II, and that of the
firm shall be placed on supervised probation
for a period of thirty-six (36) months.

oversite by the permitting employee, and
failed to obtain final inspection(s) within ten
(10) days of substantial completion of the
work.
Warren Gaskins signed a Proposed Resolu-
tion Agreement 06/15/2022.
The Review Committee found that the alle-
gations were supported by the evidence and
recommended that the license of Warren
“Tater” Gaskins, number 32971 H-3-I, and
that of the firm shall be placed on a unsuper-
vised probation for a period of twelve (12)
months. Among other requirements during
the probation, the licensee shall enroll in,
attend, and complete the Special Board Laws
& Rules course. Within thirty (60) days from
signing this agreement the licensee shall ob-
tain a final inspection of all open permits or
submit evidence of his efforts to obtain final
inspection for each job as outlined below:
The licensee shall submit a letter to each
homeowner, certified mail return receipt,
notifying the homeowner that the installation
performed is required by state law to be
inspected by the local inspection department
and that failure to have the installation in-
spected could lead to the electrical or gas
service being disconnected from the struc-
ture by the local code enforcement official.
The letter should ask that the homeowner
notify the licensee within 10 days of receipt
of the letter to schedule a date for inspec-
tion. Within 15 days of sending the original
letter, the licensee shall send a second letter,
certified mail return receipt, to those home-
owners who have failed to respond in the
timeframe prescribed above, notifying the
homeowner that the installation performed is
required by law to be inspected by the local
inspection department and that failure to
have the installation inspected could lead to
the electrical or gas service being disconnect-
ed from the structure. A copy of both let-
ters shall also be sent to the appropriate
local code enforcement official’s office and to
the Board’s office.
Hayes, Joseph E.

Allegations the licensee of the firm failed to
perform a proper load calculation, installed
an air conditioning system that was signifi-
cantly oversized, submitted incorrect load
calculation information to the homeowners,
failed to provide proper and adequate super-
vision, and violated the minimum standard of
the North Carolina State Mechanical Code.

gations were supported by the evidence and

The Review Committee found that the alle-
gations were supported by the evidence and
recommended that the license of Lynn
Kanupp, number 34186 H-3-I, and that of the
firm shall be placed on unsupervised proba-
tion for a period of twelve months. Among
other requirements during the probation, by
June 24th, 2022 the contractor shall return
to the homes located at 4515 Carswell Road,
and perform a thorough Manual J load calcu-
lation and a Manual S equipment sizing calcu-
lation, and the licensee shall enroll in, attend,
and complete the Special Board Laws & Rules
course.
